Spouse of an Asylee in the US

My wife was recently granted asylum. We got married in March 2012, before she filed an application for Asylum. I was listed in her application as a spouse and we went together for an interview. My wife was sent to the immigration court after an interview, but I was not, because at that time I had a legal status.

Recently my wife was granted asylum and I would like to know my next steps. I am currently out of status. One layer told me to file I-130 and the other one said that I have to file I-730. I am confused. Did anyone had a similar situation?

If you were listed in your wife application and you were married before your wife granted asylum , if this is the case so you are asylee derivative and you don't need to file I 730 either I 130.

Do you have i94 that says you are Asylee or derivative Asylee? If not you need to file 730. Don't go back to the lawyer who said you need to file i130???

Here is what I think. Since you were in status, you can't be send to immigration court. So your wife lawyer didn't submit separate asylum application for you but he only put your name in your wife application, so that you can apply for derivative asylum after your wife gets approved.

You are right, that's what happened, and I do not have I-94 because of that. Thank you!
