Spouse not approved and Travel

Hi All,

As i mentioned in other threads, my case was approved on 03/24 and stamped on 04/07.

I have couple of questions, i appreciate if anyone reply to these.

1. My wife's case is still pending. My attorney said, her H4 is gone after my approval. And she has to travel only with AP. Anybody travelled with primary approved, and wife with AP? any problems?

2. If her485 gets approved while she is abroad, can she enter back in US without any problems using Advance parole?

3. Probably her AP will expire while duration in home country, if she gets her 2nd AP in her absense, Is it Ok to send APs by post to her, so that she can enter witht them?

3. Some people say, it will be quick thing to approve for dependents, once the primaries are approved, is it true? if so how long?

Hi JoeF,

Can she atleast apply for 2nd AP before leaving. And can she use 1st AP to enter, even though her 2nd AP(which i am not going to send by mail) gets approved in her absence?

I meant by approving 2nd AP do they cancel 1st AP(whick might have 1 more valid month) automatically.

AP approved on absence

I am not sure, but I was in a simila situation. My wife was in India and I lost my job when I was in H1-B (485 filed).

I checked with my attorney the status, she said, I am legal to stay in US as I am adjudication candidate, but my H1 and me wife H4 is technically cancelled the moment I am terminated. So my wife has to come back before my last day of termination.

I checked if I can apply for AP and send it to her ? there is a possibilty that AP gets approved and I can send it to her and she can avail it,

but if AP gets delayed then she will not be able to come into US at all... So I asked her to return immediately and then applied for AP.

PS: suprisingly after we applied for AP, I got mine but never got hers until today (its 2 years now) (:confused: ).. we got our GC though ( a month back):D

Did u really apply for AP in her absence and got approved and entered without any prolems???
 
No No

I did not apply for AP, she came in on H4, before my termination date. If AP approved and she comes on different status, then AP will get cancelled - as per attorney
