Spouse in India-Please Advise!

Hi all,

I have my wife's I-130 approved and case pending at the NVC (NH).
I became a citizen two days ago and immediately sent a copy of my naturalization certificate to NVC.

I have few questions.

1: What happens next? (I read that NVC will send me bunch of documents, but not all of them together, one after the other? any idea why?).

2: Does my wife go through the CP process now?.

3: Can I start getting police clearences immediately or do I have to wait for NVC to send her documents?.


Is there any thing I can do to pro-actively expedite the process?

Any input is greatly appreciated.

The first thing that needs to happen is that your I-130 petition should be upgraded to an Immediate Relative (IR) category. You should send NVC a letter with your I-130 receipt number or NVC case number and a copy of your naturalization certificate, asking them to upgrade your petition.

Once they have upgraded your petition, NVC will send you a bunch of forms/fee bills in succession. They don't send everything at once, as some of the forms require a fee to be paid before they are sent out.

Once NVC completes processing of the case, they transfer it to the appropriate consulate, and the consulate will schedule an interview.

It depends on her country of residence and how long it takes to get police clearances. You should at least start enquiring about it.

Once you have asked them to upgrade your petition, give them a couple of weeks, then either call them or send them an email reminder. That is what I did.
