Hello everyone

Need advise on Spouse GC process. I am in the process of getting Citizenship in the next 6 months. Spouse is on H-1 visa. We Got married in India. What is the quickest way for the spouse to get the GC. Am I eligible for the DCF ? If yes, Can I start the processing as soon as I get my Citizenship Oath process completed. Appreciate for any suggestions/opinions from this experienced and knowledgeable community.

Well, Yes you can do that DCF but you have to stay in India for 60 days before you file at India. But since you spouse is here you can file for your spouse and do the status change. I dont have much detail info i this matter but you can do search and type for I-485 because that a form you need to fillout for change of status.

You can file petition I-130 as LPR for your spouse. You may get approval of that I -130 in 6 to 12 months. When you take your oath of naturalization you will become USC. On the same day you can file a letter to request to upgrade your pending I-130 from spouse of LPR to spouse of USC . Your I 130 will get quick processing. Simatenously your spouse should file I 485 AOS from H-1 to Immigrant, and may be I -765 application for EAD. i am not sure, but since she is on H1, EAD may not be necessary in this case. please check with USCUS.
It appears your spose is already in USA. So DCF is not for this case. In case spouse is in home country, then DCF is the better option.
