Hi,
I have heard that when working for an employer on H1, if the employee uses EAD to switch the emplyer (who filed H1/EAD) then the employee cannot switch back to H1 in future (if that is needed). How does it work for Spouse derivative beneficiary?
I work for Company A on H1 and got EAD. I haven't used it yet. My wife got EAD as spouse beneficiary. She is working for Company B on H1. Now she wishes to move to Company C on the EAD. Since I am not certain whether my GC will be approved (because of retrogression and other job issues), I want her to have an option of getting back to H1 later if needed. Is that possible? The company C is not good/prompt when it comes to immigration issues (including filing for H1 transfers)
