A brief history before I talk about her case..
She is an F1 doctorate student..and currently on CPT in Nebraska for a year only...she is a student in Mississippi which falls under TSC jurisdiction.
I filed my wife's 485 along with 765 to TSC (RD sept. 26th 2005) .. TSC returned the application on 29th sept. advising to file at Nberaska Service Center since it was not under their jurisdiction.. then I fedexed her application to NSC and it reached on 30th sept.. NSC returned the application saying that since it's a derivative application..it should be file at the center where underlying peition i.e. principal's I-140 was approved...that is TSC again... so using all the evidences I sent the application back to TSC (with special attention to the director).. telling them it was wrongly returned and I-485 should be files retroactively to the initial date of reciept...i.e sept. 26th... since the visa numbers were available this time...
They did file the I-485.. and I got the reciept today... everything is fine..but the reciept Date says Oct. 25th 2005..instead sept. 26th... there are no visa numbers available for EB2 from retrogress countires..so how can they put reciept date at oct. 25th... and I explicitly ask them to retoractively file to sept. 26th..since it was TSC's error that they sent the application back to me when it was filed in timely manner..
I did read on murthy bulletin today...that there were lots fo cases wrongly returned by TSC which were filed in last week of september..and TSC has realisede their mistake and asked people to resend the application with a proof of iniatial filing date in septemeber...
I have an appointement with murthy's lawyer this monday morning to talk about it... and get some guidance on how to get them to change the recipet date on the notice...
but..has anyone on the forum has any experience like this...or any of their friends... Please advise...
