Hello,
My wife was on F1 visa. When her visa expires she continues studying MS in another school and school has provided I-20. To stamp Visa on passport she needs to travel out of country.
After our marriage we file I-485 and we have received EAD card. Now she is no longer fulltime student but she is working under internship.
Our layer advises us that after filing I-485 – Adjustment of status we will be all set with our visa status. But I found that someone’s spouse’s Green Card got rejected because she was not having valid visa status during her full stay in US.
Is my wife is technically out of valid visa status? Should she apply for her H-4 visa ?
Thank you,
Dattu
