Hello everyone, I got married after I got my GC. So, I've been looking at ways to get her here.
Things I'd like to know:
Does my address have any bearing on her application?
I think it might affect which office the thing goes to, but it has no significant effect.
Is it ok to switch jobs?
Do I have to stay employed while her application is being processed?
During the stage of waiting for a visa number, your employment doesn't matter. After a visa number is available, and you go to the next step (Adjustment of Status in the US, or Consular Processing outside the US), you will need to file an Affidavit of Support, and you will need to have enough current income at that time to meet the 125% poverty level guideline. And if you don't meet it you will have to use assets and/or get a joint sponsor.
After filing the Affidavit of Support, changes to your job situation do not invalidate the affidavit. However, at the interview they will probably ask if you are still in the same job, and if not, ask you to submit a new Affidavit of Support. So if you lose a job during this time, make sure to get another one before the interview.
Is the visitor's visa the best way for her to be here while her F2A is being processed?
If she has to apply for a visa, it will most likely be denied. If she already has a visa, it's possible she will be denied entry. There is no absolute prohibition against her visiting as long as her intention is to stay briefly and then leave, and not file I-485 while she's here; however, it's very difficult to overcome the presumption she's intending to use the visa to immigrate.
Also, in what situation is it ok to file i130 with i485. I read that i485 should only be filed as step two once the priority date in your visa category is current. But the information on i-130-addresses page on uscis suggests that you can file i130 with i485. What am I missing here?
First of all, I-485 is Adjustment of Status, which is only for if she is in the US. And they can be filed concurrently only if the category is current. F2A is not current right now.
