Ok i got married December last year, I have all but the i-864 form filled out. I am here on a student visa and i can only work 20 hours a week. my wife is a student too and she doesn't work. My question is, can my wife still be my sponsor? Her parents are willing to to stand as my sponsor, but her dad doesn't meet the minimum household requirement and her Mom stopped working because she got hurt but she still gets paid every week. Can they both joint sponsor for me? and if they can, what form should they fill out? please i really need help.

Hey,

Anybody in the household who does not have any sort of income can not be a sponsor on their own.

However, if your in-laws together meet the below the poverty line requirement then they both, together, can be your sponsors.

You need to fill the I-864 and I-864A (sort of a join sponsor application)

You may in any case wanna make an info pass appointment if possible to verify and ensure that you guys have everything yall need to make this a success.

All the best!

If she is the one filing I-130 for you, she is the sponsor and must file I-864 regardless of her income. If she doesn't have sufficient income, you can add a joint sponsor(s) or household member(s). See the I-864A instructions for who qualifies as a household member. Household members would file I-864A; joint sponsors who don't qualify as household members would file another I-864.
