Good day Everbody,im new on these parts, and bring and odd question..
a little of background , i came to this country 5 yrs ago , i got married on Aug 2018, we waited a bit to start all my paperwork for a GC on.
i started to look for a sponsor due to the fact my wife doesnt reach the minimum....its been a really unfruitful quest, stressing and frustrating...
Seems everybody is just totally obnoxious to hear just the term Sponsor. Her parents.....lets say they didnt approve me, mostly for racial factors, so they arent helping nor her family and I Dont have family here...
now my question , is there a way ,a workaround per se, to just skip the sponsor part? it seems is gonna be a lose battle ,everybody is just too affraid i even offered money just for the help, they even know i CANT claim any government benefits the career im picking once my paperwork is done , doesnt allow ANY type of goverment aid, if that makes any sense....
i dont want to divorce for that reason, we cant start a family for that very same reason.....i truly wish someone could just give me an hopeful advice
thanks in advance!

So what's your status? If you are authorized to work in the US right now, then your income can be counted in your wife's household income.

There aren't really any good workarounds. One is if you have earned 40 quarters (i.e. 10 years) of Social Security credits (i.e. worked in the US paying Social Security tax for 10 years), including the credits earned by your wife during the period you were married, you don't need an Affidavit of Support. But given that you've only been here 5 years, and married for 2.5, I don't think you can possibly meet this.

It's not true that you can't claim any government benefits. It's complicated, and there are some benefits that you might be able to get. Ultimately, the sponsor needs to either be willing to pay you if your income is insufficient, or trust you that you won't sue them or get any government benefits you might be eligible for, and if they don't want to pay and don't trust you they are right to not do it.

I am not sure why you can't start a family. Is it because you are not authorized to work and you don't have the money for a family?

hi! yeah im a F1 (my visa expires this year) , so i cant work , been studying all this time...i could work but thatll be illegally...
also for the career im looking, getting any type of government benefits is a auto DQ, thats why i dont want to even think on getting em
so basically what youre saying is....... if i work for 10+ yrs i wont need a sponsor? thats too long.... man...

Visas are only for entry. The visa's expiration doesn't matter for your stay inside the US. You are almost certainly admitted for D/S, and not a date, on your F1 I-94. This means your F1 status lasts indefinitely as long as you have a valid I-20 and comply with F1 rules. When you graduate, you can work on OPT for 12 months, which can be extended a further 24 months if you are in a STEM field.

thanks for the response, as for my status im not really worried about (also is just a language school), is more the fact i cant get a sponsor....which is really a frustrating thing......now i have a question that recently popped out, if my wife can get a join sponsor , means this other person is going to be responsible for me or her? like is the joint one is gonna be responsible for her and anything that happens to her? or is a shared responsibility?
thanks in advance!

You're the immigrant. The obligation of a sponsor (both your wife as the petitioner, as well as the joint sponsor, are sponsors) is to supplement your income to reach 125% of the poverty level if your income does not already reach that level. A sponsor is not "financially responsible" for you otherwise. The joint sponsor is not "financially responsible" for your wife.

If the sponsors fail to meet their obligation (of supplementing your income to 125% of poverty level if it does not already reach it), you can sue them for the difference, or the government can sue them for reimbursement if you use a need-based government benefit. They are "jointly and severally liable", meaning that either sponsor can be sued for the entire amount.

I still contact my local office for detailed advice! Many people very often postpone the trip to the local office or just don't know where it is! But I came across such a useful platform, it contains all the provisions, opportunities, services that all offices will provide! It will be useful to stop by and read!
