Regarding my RFE notice. BCIS issued a RFE on July 02, but so far I didn't recieved it. Because of my lawyer stupidity, changed address but never informed bcis about it.

3 Weeks back I spoken with one to send notice to my address instead of lawyers address. Nothing happened so far, called one more time gone through same procedures. I don't know what to do?

Such a frustrating Journey?

FP2: 07/18/2002
REF Issued : 07/02/2003

Request your Lawyer to talk to BCIS and make them fax the RFE details to Lawyer !

If your Lawyer is not responding.. go for another. Do something fast... 30 days gone, BCIS gives only 85 days to respond, NO Extension !!!

Hi manumahi,

Did you move or your lawyer moved ?

The way I understand is that your lawyer moved but never informed BCIS about her/his move and since RFE goes to the lawyer, the lawyer did not receive the RFE ..

Is my understanding correct ?

Thanks

in case any body is browsing this forum ?

manumahi, you said you contacted local office, why you need call BCIS customer service? Local office can't answer your questions?

Thanks for your response.

CMACTI,
IS BCIS does fax service? Are you sure about it. Because it is my lawyers fault. I can ask him. Please respond.

thanks

manumahi, don't talk to first tier representative, they know nothing, ask for "Tier 2" directly. They will allow you talk to "Tier 2" and probably can help u more.

VSC does not have fax inquiry.

did you go to local office, can they help you send an inquiry?

I tried it. No luck. Tier 1 was stubborn about answering my query.

If you ask about your case status, no way you can go through to Tier 2.

But for Manumahi case, he maybe able to get to Tier 2.

Don't say "I want to get my case status".

Manumahi, can you try this

"My RFE has been issued for a month, and I haven't received it yet. Law requires me to reply in 85 days. If I don't reply, my case
will be denied. Please let me talk to a Tier 2 representative, and
let them send a request to VSC. This is urgent."

Or, try your luck with a local congressman, if he's nice, maybe he can help you.

One more thing you can send written enquiry to Vermont office. Instead of going through NCSC, you can send enquiry form directly , which you can get it from local office.

Spoken with Tier 2 person in NCSC. But no use. What he told me is to contact Vermont directly. Spoken with my lawyer. He is doing below procedure. Any one in my situation can use below procedures.....

My lawyer made two sets

Each set containg

1. G-28 form with my signature
2. Conver latter stating about our Reciept number, A# number etc. Explaining the problem. Asking them resend RFE to new address.
3. Enquriy form, which I got it from local INS office.

One set he send it to P.O.Box 600, .......VT
One set he sent it to Regular vermont address

He is expecting atleast one will click.

Keeping my fingers crossed.

Thinking of contacting my local congress person to expedite the process.

If you have any more suggestions please advice me.

Thank you all for your support.

For your information,

Yesterday I spoken with NCSC again, and Convinced them to speak with Tier 2 person. Tier 2 told me that he don't have any powers. Told me to send a written request to Vermont that will be better option in my case.

For your information

Local office can get your application details like EAC numbers, A# numbers, EAD numbers, Can check status of your application etc. But they don't have complete access to that file.
