Congratulations SPEK! This is really a good news and I am very happy for you both. You guys really had a nightmare time for the last two weeks, so you should take a really long vacation from today itself.

Thanks alot SPEK for really nice words. To be honest, all I am doing here is helping myself more than anybody else as by answering to all others issues, It gives me some confidence in the stressful GC process! Once again Good Luck and Enjoy your freedom and have a nice really long weekend! :)

Just for the sake of understanding your reply to NOID, all your Lawyer replied was that since they have approved your H4 after the gap of 183 days, it is implied that they have waived your Out of Status period. So now they cannot raise the NOID as this issue was already resolved as you are now already in status.

Yes, you are right; my lawyer replied to NOID as "we applied I-539 to excuse delay in filing after 120 days of I-94 expiry and the INS approved the application. So the approval means they reinstated the status irrelevant of the dates in the notice" and also she has quoted "it’s technical error my INS and we are surprised to receive NOID in this matter"

My lawyer was very confident from the beginning and argued that I never crossed 180 days and NOID was INS mistake and we have to educate them.

She is the same lawyer who gave us hope when we came to know that my I-94 was expired and I may go into 3 years bar. Even at that time she said "don't worry, don't go out of US, we will apply and if they deny, we will fight". I thanked her a lot yesterday and I will never forget her help.

congratulations spek ! It must indeed be a huge releif and joy for receiving the approval after all the suspense and tension you had to go through. I know you were exploring the option of going to Canada and getting H4 stamped, good that you did not do it. As always it is better to remain in US and fight it out.

Thanks for your wishes and support. Yes, I was thinking of various options H4, Motion to reopen, appeal etc if they deny my case. I was bit confident that I can fight the INS in this matter but my concern was the EAD status and so it gave me a very hard time.

I thank GOD and all the people in this forum who supported me and prayed for us.

Congratulations!!!. I am really happy by seeing your post. It proved that INS guys has logical mind. Your post should help some of our folks who has this kind of situaton. Enjoy the freedom. It is party time !!!
