Speeding up the process???

Hi there,

I have been offered a Job in the USA and they want me to start in October (13th). The company have filled out the I-140 petition back in July but the process will take too long. They have asked me to find out about a way to speed up the whole Visa process to allow me to start working in October as they have been advised this is possible at an extra cost.. Can someone please let me know how I can do this

You will have to come in with H1 visa. Ask your employer to file paperwork for H1. I-140 is the route for permanent residency (green card) and will take 2-3 years to process. That process can go on while you work on H1.
For H1 there is "premium processing" available that allows H1 to be processed in 2 weeks. It costs an extra $1000 and a good immigration attorney is required to help submit the required paperwork for premium processing.

Attourney cost

Thanks for your reply,

I have a further question. I have been passed details of an attourney which I will pursue on Monday. Does the $1000.00 include attourney fees? If not how much approximately will the whole process cost so I can present the information to my prospective employer.

Also, I am here in the USA at the moment visiting. Can I do everything I need to do here or do I have to return to my home country?

No, the $1000 is just the fees for premium processing. Lawyers will typically charge an additonal $1000 to $1500.
If at the time of approval you are in the US you can begin working immediately. Otherwise you will have to apply for an H1 visa in your home country. For that you will need the original H1 approval, a letter detailng the employment ( job description, salary, etc.), forms for the visa and fees.
