1. U can ofcourse use ur EAD and for work in any position, similar or not - that is precisely what EAD is for.

2. However, u may ("may", not "will") run into trouble with BCIS, if they question u on ur being out of "similar" job. Granted u have a letter for future employment from company B and GC is for future employment, but BCIS several times takes current conduct as an indication of future scenario. For instance, at approval time, they may ask u for W2s to prove that u were doing similar jobs till date and hence are capable of doing the job mentioned in ur future employment letter.

Best is to get a similar job asap. While u are searching for that, u can surely make some bucks on the side working the unrelated job.

goodluck!

Thanx Atlanta

How about I get on Payroll of Company B, about 3 months before BCIS hits applications of my batch.

The guy in Company B is ready to co-operate at all extent. He says If I can get 1099 from wherever I work, he can give me W2 from his company as a permanent employee. As I am working for Company B and on contract with any place I work with.

Cheekoo,

Ur approach may work but is a risky one.. As of now, it appears to be ur best option but that shouldn't stop u from continuing to try to find a similar job.. Keep this approach in the back pocket and try to find a similar job so that ur case is as straight forward as it can be, and thus with minimum risk.

Read this week's chat with Shusterman on About.com - especially Q5:

Also try hiring a competent lawyer, a few hundred bucks is definitely worth investing in immigration which affects all rest of the lives here...

goodluck!
