Hello...
My EAD is expiring Aug 28 2010, and My company take care everything on behalf of me and unfortunatly they applied only July 14 2010. Based on the current back log I am not going to get new EAD before 28th. So Comapany processed new H1 through counsular process and Asked me to go and stamp it in India or else where.
My old H1 expired Jun 8th 2010 which I haven't stamped , my company was extending because I have I-140. Now new H1 starts Jun 28th 2010 to Jun 8th 2013.
I have travelled to india and came back on Aug 28 2008 and I have I-94 based on that ...
My questions are...
If I go and do stamp H1 and H4 for my wife ... Is there any impact to our pending AOS. ?
Since we have new H1 and according to my company this is another kind of extn , Do I need to stay back india for an year ?
If I get my H1 stamped can I come back using H1 and when I get new parole can I use it future ?
Please help me since I am very concerned and I am with the same company for past 10 years..
