Students Sue Universities for Denials Based on Perceived
Immigration Status

The Mexican American Legal Defense and Educational Fund (MALDEF) filed a lawsuit against several public colleges and
universities in Virginia on behalf of students who are graduates of Virginia high schools, but were denied admission to the
colleges based upon their perceived immigration status. The seven schools involved in the lawsuit are George Mason
University, the Northern Virginia Community College system, Virginia Commonwealth University, the University of Virginia,
Virginia Tech, James Madison University and the College of William & Mary.
The lawsuit, filed on September 3, 2003, has roots in a September 2002 memo from Virginia Attorney General Jerry W.
Kilgore which reportedly "strongly encouraged all Virginia public colleges and universities to deny enrollment to students they
believe to have an undocumented immigration status." A MALDEF Press Release reports that many of the students affected
by these admission policies, which the lawsuit alleges are in violation of the U.S. Constitution, are not "undocumented," but
rather are "living in the U.S., with the knowledge and consent of the United States government...have social security
numbers,...pay federal and state taxes."
Reactions of various individuals and groups throughout the country are mixed, ranging from agreement with MALDEF that
the schools are usurping the authority belonging to the federal government to outrage that there may be a suggestion that
illegal immigration should be overlooked, condoned, or accepted.
