SPAM: DREAM act only for illegal?

I went through the Dream Act. Do you think kids of legal immigrant will be eligible to apply for green card after living five years in US? No!

An alien shall be considered to have failed to maintain continuous physical presence in the United States under subsection (a) if the alien has departed from the United States for any period in excess of 90 days or for any periods in the aggregate exceeding 180 days.

It means if H1B or AOS pending person sends kids every summer to your home country on vacation kids will easily pass 180 days mark soon and become not eligible for Dream act and will continue torture with their parents.

It seems the above bill/article is solely talking about' Illegal Immigrants/kids 'and 'undocumented'.
Normally who is on H1B or AOS,AP the dependents will be brought on 'Well documenation' like H4 while they first enter in US and they will I-94 at POE(auhorized entry).Also,seems
if they have H4 it is of 'multiple entry' and the stay out side the US is some kind of 'Authorized'.
Hence the above bill is releavnt for kids having H4 or AOS AP? at all.
If my view is wrong please calrify.
