Do you see any problems with the following plan:
1) You reside in the US on green card for 2.5 years and are physically present for 1 year 9 months. You only made a couple of short trips none more than 4 months at a time.
2) Your father dies who was an owner of a business in your home country. You need to go to your home country for an extended period - up to 3 years to
- Learn how to manage the company
- Create a financial stability for the company to allow a manager to be hired abroad to run the business abroad
- Move parts of the operations to the US and manage them yourself.
Please note that the company abroad makes about 2 mln USD per year and is small (15 employees).
As you know to accomplish this takes significant amount of time and it will be necessary for me to be in my home country a lot.
As a result I plan:
a) Apply for Reentry Permit
b) Store some of my belongings in the US
c) Continue to own my car in the US, I will have to store it in a garage - it is worth 15K.
d) File tax returns
e) establish US branch of the company and be paid by the US branch. Initially the US branch will be 1-2 people operation
f) Continue having credit cards in the US
g) go to my home country a lot but for short trips - so one trip would take 5 months at most.
h) Live and work in the US for 4 months out of the year. This will allow me to spend significant time in my home country while keeping strong ties to the US. Whenever I come to the US I will probably rent an apartment or some long term stay - I do not want to rent an apartment for the entire day and have it vacant for 8 months out of the year. When I come to the US I will use the car I own here.
4) At the end of my 5 year period I will accumulate about 2 years and 7-8 months of physical presence in the US plus no trip more than 6 months.
At that time I should go for a 90 day period to the US to establish a residence, rent an apartment for couple of months and try to get naturalized.
