SOS/K1 I485 rejected/Medical Exam TB(skin test)positive/need I-601 form n $265 chk?

Here's some questions I concerned after the rejection, plz help me :( .

I know we made couple mistakes, so this time I have to make sure everything's correct, need a 100% score. My concerns are:

1. USCIS mailed everything back to me, can I use the same paperworks and resubmit back to them again, there's only some minor marks on the paper.

2. I keep thinking I-130 form, so I wrote them a $130 check, I know it should be $190.

3. I-765 EAD should be $180 only, the biometric fee $70 was included in I-485 already. Though I-485 should be $325 plus the biomeric fee $70 totally $395. I wrote them one check $395, do I have to split it into two checks, one @ $325, and one @ $70? Make it seperatly two checks?

4. I included my medical exam I-693 this time. I've read some threads that part of you did not mail a medical exam to USCIS until the interview day; I've read instruction on USCIS website, it says I-693 must included in I-485 application, but also says you hold it on until the interivew day and bring it along with you. So I confused, not sure if I need to included in the package or keep it with me until my interview day. If I mail it means I have nothing for interview coz it's been sealed in the envelop from doctor, then I may need another exam done before interview.

The other problem I have is I did not pass my skin test (my tuberculosis result turns positive, but I have a very good chest x-ray, means I'm being infected with TB but not having TB disease yet). I'm taking medcine now, another 3 months to go. I know most of you may have the same problem like me.

USCIS website said if someone TB is infected you should have to file another form, called I-601, Application for Waiver of Grounds of Inadmissibility. Can you tell me if you've done this I-601 if you are a TB infected. They said if you did not file this form with your unpassed skin test result, then USCIS will hold your entire I-485 package until you complete your observation (taking those pills to control the germs in your body so you will not wake uo to spread virus to someone else). Is that true? Do I really need to file this form?
On I-601 Application for Waiver said, No fee is required if this application is filed for an alien who is AFFLICTED with TB; is mentally retarded; has a history of mental illness. So I did not write them any check, but now I received a rejection notice for this I-601 said: The check amount is incorrect or has not been provided. The correct filing fee is $265.00. Please resubmit the application with the appropriate fees again. What should I do? Any suggestion??

1-I think u should use new form to avoid any confusion.(my opinion)
2-send I-130 check with correct fees.
3-U can send one check for I-485 and F.P
4-send ur medical ex.(I-693) along with the package or u will receive RFE which will delay ur case.If u dont have interview within one year only then u have to repeat med.ex.(mostly its within a yr.these days unless Godforbid u get stuck in name check)
5-Mostly people from Asia get a positive skin test for TB which is OK,u just need a clear chest X-ray(wonder why u were given medicine if u didnt have an active TB or +ive chest X-ray).The reason for +ive test could be that u were vaccinated against TB when u were born,depending on the country u were born.
I dont think u need to file for I-601 but if anyone else has been through this could give u better advice.
I had positive skin test too,but got away without chest X-ray as I was pregnant and had a X-ray within one year which was clear.Didnt get any medicine.Hope this helps.

1. What the notes say? You can use the same forms if nothing has changed, or use a new ones and be sure that everything on it is correct. Verify the fees with the 800 number or on the website since the fees changes with time. Be sure to verify that information.
3. On the check for the I-485 you include the 70 biometrics fee on it.
4. I think your doctor is the one who must know if he must fill out your medical or wait until you get clear out (end of your treatment). In that case you must wait until your medical is finish so you can submitt all together. That can take several weeks.

About the waiver, I don't know, but by the instructions on the form it is suppose that your doctor as well must make a statement on form I-601, what does your doctor said?

For information about why you get a positive TB test the best way to know is through your doctor. If you are an adult and you got vaccinated long time ago the probability that your TB test is positive because of that is very minimum. To have a TB test positive means that you are infected, but they need to know if you have an active or no desease. Does not mean that you have the desease, you could be expose to the bacteria through other people as well. If they are giving you medicine it's because the right course to go.

I have a MD degree and thats why I said vaccination at birth still can give a positive result.Having positive test does not always mean that u r infected.

1. you can send new or old package. doesn't matter if nothing is wrong with your old package except for the fees. it's up to you. just make sure everything is written correctly on the forms.
2. yeah send correct fees
3. send a check for $395....you don't have to separate it
4. send your medical with the package....my friend didn't and got a RFE to send it and it's delaying everything...so just send it now. you only need a new one if your interview is after one year from the day you sent in everything...or from your ND.....cuz medical is only valid for a year.
5. look the public health dept of the state will give you meds if your PPD is positive...that's because they are pretty aggressive when it comes to TB, but it doesn't mean you can spread the disease, cuz your chest x-ray is negative. your civil surgeon will probably tell you that your ok cuz your x-ray is clear, and will indicate this on the form s/he is going to fill out. so you don't have to fill out form I-601. that's only if you have ACTIVE TB, and you don't because your x-ray is clear.

If i were you, i would start with a new form.

Your application was most probably returned for this reason.

Submit one check for I-485 that includes the I-485 fees and the biometrics fees.
Submit one check for I-765. Do not include the biometrics fee with this check as you already paid with the I-485 check.

Send the sealed I-693 with the I-485 package. If no Class A or Class B medical condition found, the results of your medical test will be valid till the I-485 is adjudicated.
