Sooo worried!! - Citizenship

Hello everyone,

I have been a long time lurker but now am a first time poster. I have gathered a lot of information in the past month and thought I would get myself involved.

My situation: I just became eligable for citizenship in August of 2005. I applied on January 9th, 2006 and hired a lawyer to do all the filing for me.

The problem: I fell in love with a girl from india 5 years ago and have been in contact with her since. We both decided to marry eachother but her parents are not going to let that happen until I get my citizenship. She has a 10 yr. multiple entry visa but yet they are hesitent to marry her off. We are trying to plan our wedding end of August 2006. there are a few questions I had:

Q1: I live in NJ, so where would all my information get processed? Newark or Cherry Hill?

Q2: My engagement date in India is Feb. 26th and leaving for india on Feb. 21st. Will I get my finger printing done before then? if not, is it easy to prepone or postpone?

Q3: Would contacting a congressman help in speeding up the process?

Q4: If we throw a wedding reception only in the US after we come back from the religious ceremony in India, and we don't register the wedding until I become a Citizen, will it be a problem for us to throw a reception on her Visitor's Visa?

Q5: Seems like it takes on average 8 Months for the entire process, so if my wedding (end of august in India) comes in the middle of the ID, can the ID be postponed?

This entire experience of ours has not been a typical 'falling in love' experience. I fell in love with her 5 years back and she didn't. I pursued her for all 5 yrs until I went to India in Oct. 2005 to sweep her off her feet. Now I just don't want this Citizenship process to get in the middle of us two now. Its been hard as it is...and i''m sure everone has had their own experiences.

Any help would greatly be appreciated as I know there are alot of knowledgable people on this forum. Thanks in advance :o

All I can tell you is that you have filed on a good day: JANUARY 9th, 2006. That's the day I became a Citizen. :D

Good luck.

1. Where in NJ do you live ? That determines the DO
2. Hard to say. Make sure someone receives your FP appt letter for you
and reschedules
3. Speed what up ? You just applied. No they cant help you expedite
a non emergency (life or death) case
4. Registering marriage and sponsoring spouse are 2 different things.
Register the marriage in India, sponsor her after your CZ
5. What is an "ID" ? Interview Date ?

I live in Ocean, NJ zip 07712
I just wanted to see if I could speed it up since the average timeframe is 8 months, I just don't want that Interview date to fall in the middle of my marriage in India.
Yea, Interview date

I just want to make sure that I do this correctly, because they are all counting on me to make this happen. I just don't want to let anyone down :(

Thanks for any futher information

why would they expedite your case? If you were terminally ill (god forbid) or on your way to fight the war in Iraq I'd understand. but just because you're getting married. There is no way a congressman would intervene in such circumstances.

well, you can have a short and quick wedding / marriage in India. How long does it take to get married in India? 1 day? 1 week?

from USCIS' point of view, getting married is not even a valid reason for speeding up the case.
I would see if someone who gets stucked in the citizenship process for yrs, they should be deserved some helps / speed up.

Under what Visa is she planning on entering the USA? (a visitors visa? after her marriage to a LPR (you) till you become a USC?) Won't that be a violation of the visitors visa? (pre-conceived intent to immigrate?) or did I misread your post?

it wont be a violation unless she plans to stay in US, overstay it, and file the petition for the immigration. so USCIS will look at it as the "intended to immigrate" on a non-immigrant's visa thou.

If she comes to US on a vistor visa, and if she leaves US per her visa, it is ok.

It will be hard to convince the officer at the POE that she has the intent to leave again, though.

true, but it is a different issue of what "sachinphadke" mentioned.

Hi guys, excellent feedback. I guess i really can't ask to expedite it because of my marriage dates. :(
She will be coming here on a B2 10 yr. multiple entry visitors visa. I believe the only thing she cannot do is 'work' in other words get a work permit. But I don't know if throwing a reception will hurt her in any way if someone finds out.... from my point of view that sounds ridiculous but her parents are very 'scared'.

A marriage typically takes about 1 week in India.

I will only be filing for our legal marriage status after one month of becoming a citizenship. So this way atleast she will still be here on a visitors visa without a problem. Also, if she studies in Kaplan Courses (medical courses) she can get a student visa right? What would be the best way to act upon my situation of bringing her safe and sound :o
