It was 125 days I am out of job, I am on H1
Now I want to change my status to H4 as my husband is on h1(and also as I couldn't find job).
Can I file for H4 in u.s.a(I heard that they ask for recent paystubs to check until when i was employed with my h1)
Or should I go out of country (canada, mexico,india) to get
h4.
Please help me
 
It was 125 days I am out of job, I am on H1 certainly 125 days or roughly 4 months w/o paystub would create problem. what do you mean by out of job? are you terminated or not getting paid due to non-availability of project by your consulting company?

h4. not a good idea to canada with your paystub issues. once canada rejects your visa appln then you may not enter into usa in the border.

assuming that you work for consulting firm and you are on bench without pay or project then request your employer to give letter stating you were on leave due to personal reason for the past few months and now you wish to take even a long leave so you consider changing your status to H4. this may work.

try to file h4 COS from here. if it does not work out then you may have to go to home country and get h4 stamping and return back. remember that consulate may ask for paystubs and w2

yes i agree with you that benching in h1 is illegal. but what would the h1 people do. it is employer mistake. may be h1 people can complain to dol. unfortunately most of them do not complain.

i do not intend to ask the original poster to lie. but h1 people should cover themselves from the mistake and abuse of their employer. Apologize if my posting is misleading.

person on h1 on personal leave is in h1 status provided the h1 person and the company could provide strong evidence.
