Some trends !!

Guys,

Not sure if I am right but I have noticed the following trends at TSC these days.

1. EB1 and EB2 cases are getting 140 approvals and then 485 approvals pretty much at the same time. It seems like the concurrent process is still being applied to some of them while the others are getting approved within days or weeks of eachother.

2. EB3 cases with PDs BEFORE JAN 2002 (current PDs) are getting their 140s approved and the 485s approved shortly there after.

3. EB3 cases with PDs AFTER JAN 2002 are getting their 140s approved and the 485s are not getting approved. 140s for these cases are getting approved at a very fast rate. I have seen quite a few 140s with RD in June, July, Aug 04 being approved. I guess this makes sense because they are probably using the freed up resources to approve 140s.

I guess your assumption is right. But now the question is, how much time it will take for the PD to be current or people with PD after january 2002 will stuck for dont know how much time. IS there any calcualation or some way to find out when the PD will be current?

EB3 only..
other question is, even if PD becomes current, all the concurrently filed I-140s will still go thru the short cut or will they need to wait in the I-485 queue??
I am just keeping my fingers crossed for the short cut but TSC can favor any logic.. we will need to monitor for a couple of months from here on..

Here is what I read

gckajadoo,

In an article on Murthy.com I read that the PD is supposed to move from Jan 2002 sometime in March. I got the impression that they will review the visa numbers every quarter and move the date accordingly. What the new date will be is anyones guess.

From all that I have read it seems that cases with PD after JAN 2002 will not be adjucated concurrently. I think the 140 and 485s will be processed separately and the approved 140s will be put in a separate 485 queue.

Let me stress that these are my assumptions based on what I have read at various sites and forums. We all know that anything and everything is possible with the great BCIS.

good luck,
