Hi Guys ,
I have a friend who works in my office. She is a USA citizen, she has married a person who in USA for more than 5 years. No visa, Just crossed the border. She met with Attorney and the lady told him she can get him GC, and she would charge her $9000.00. She told the girl that as per the new law he can get a GC.
They would apply for the 130, 485 in usa, then he would be sent back to his country for the GC visa, and they will denie the visa. and the girl how is a USA citizen will apply some kind of papper atating that she has a baby with the man and needs him to live with he rin usa. and then he will get the GC visa in the home country.and come here.
The entire process will take 8-10 mts.

Is this true?
I told her it is not.
Can any one tell me if i am correct ?

I believe I understand what you are talking about. Since he entered without inspection, he will need to go back to his country in order to adjust status. But if he does that, he will be subject to a 10-year ban for unlawful presence, so he will need to apply for a hardship waiver. Before, he can only apply for a hardship waiver after he leaves the U.S., which is risky since he doesn't know if he will be denied and be stuck outside the U.S. There is a new rule from the Obama administration that is taking effect now which allows him to apply for a "provisional waiver" while in the U.S.
