Some latest Approvals....

There have been some latest approvals from April and May 2002. Why would BCIS be approving these while 2001 cases are still pending? Are these religious cases or employment base?

Just wondering.....

Though my ND is 04 02 02 (FP 05 31 02) employment based one of my colleague (Russian) got her case approved 2.5 months back. (5th June, 2003) Her ND was after me ie 04 09 02. Her entire family. Right in my company. Its so unfair.

Can u imagine. Its really disgusting n frustrating.

My ND is 07/15/2002 but just wondering.....what is going on....

One side BCIS says that they wont touch the employment cases and then all these Aprl and May cases gets approved before the Nov-Dec 2001 ppl

Feel sorry for Nov-Dec 2001 ppl...seems like they are just being ignored badly....
 
Yes, CSC is approving a lot of cases out of order. Though, their present overall approval rate is close to historically low. You can see the picture based on the whole wac-02-xxx kashmir's scan in this thread (http://www.immigrationportal.com/showthread.php?s=&postid=569870#post569870).
I have no explanation for this. Some people here relate this behavior to kind of "sampling" or "training" schedules. Normally, about 1% of i485 cases, independently of ND date, is approved very fast - those must be "high-priority" whatever that means.

I understand all the frustration, but I think they are actually doing some sampling, and it's not an "out-of-order" processing - see below:

Adjustment Applications
The adjudication of these cases continues not to be a priority at this time. Inquiries may only be made on cases that are 30 days beyond the date noted on the Just in Time Report. CSC is not in a position to adjudicate cases just because fingerprints may be expiring. Notices for re-fingerprinting will be issued.

The CSC did pull a sampling of cases which were filed first half of 2002 - the purpose was to determine if all the fingerprint clearances would be expiring. The sampling did not establish the expected pattern. However, rather than just re-filing these cases - they were processed. Some cases were approved, others received Requests for Evidence. This explains why some cases have been processed out of chronological order. However, at this time the CSC continues to process cases chronologically.

CSC confirmed that prior to granting any benefit to an individual, an IBIS check must be conducted. This check is valid for 35 days. However other third agency checks may be required (this would be determined on a case by case basis). Additionally, the FBI check is valid for 15 months.

Concurrent Filings
Applications for Advance Parole and Employment Authorization (EAD) will not be adjudicated until the underlying Employment Based Visa Petition (I-140) is approved. However, if the EAD application is pending for more than 90 days and no Request for Evidence (RFE) has been issued on the underlying I-140 OR a response to an RFE has been filed more than 90 days, the individual may go to the local BCIS office to apply for an interim EAD card.

Employment Authorization Applications (EAD)
The processing of EAD applications should continue to improve. CSC hopes that by the early June 2003, processing time will be within 90 days.

Request for Evidence (RFE)
If a response to an RFE was received by BCIS more than 30 days ago without a decision, an inquiry may be made. The inquiry system is now just a two-tier system, i.e. sending a fax to the Product Line and after 15 calendar days, an email may be sent to Division XII.

NSEERS Registration
If a beneficiary or applicant appears to be subject to NSEERS Registration, CSC will need to verify that registration has occurred before granting the benefit.

H-1B Visa Petitions
These cases will continue to be processed status quo.
 
My I-485 was approved last August 29,2003 and up to now I cannot believe that it was already approved.Though my lawyer received a copy I still have to wait for it as she had mailed it today, i might use that one instead of the courtesy copy provided.
On what strange of the best of luck that mine is a May '02 case was touched and approved, is something that up to now I cannot fathom.Good luck to everyone anyway!

Hi: I do not think that europe or asian country matters.

I know at least five people coming from diverse countries like Bulgaria, Russia, ofcourse China & India. Their filing dates range from October 2001 to May, 2002.
None uptil now have heard anything from BCIS. Not even re-FP or RFE.

All those are assumptions about sorting cases. Its but obvious that BCIS cases are picking cases by tossing coins.... the reason being all the files/cases are numbered chronologically and should follow simple math. Alas that's not the case...


So it does not matter whether u r from Europe or from India/China or from Timbuktoo.

The policy is to drive all the potential immigrants out of this country (by delaying the I-485-either by lay off or company closures) so that they can hire so called "learned" US citizens who are twidling their thumbs for the lack of jobs.

Its just that the BCIS does not want to do it... simple as that. Regarding religious workers tell me honestly in America more than 70% population is agnostic that leaves only 10% athiest and rest 20% somewhat relgious. so can anyone tell me how many religious workers are being sponsored. Just a lame excuse.

Anyways! its the frustration ....

This is kinda scary....seems like its all luck these days...you could have applied in June 2002 and get approved.....

The only thing scaryin me is that I wanted to travel and also get my H1 stamped when i am away...if the approval comes when i am out of US then i am kinda screwed coz my AP is expired and my H1 stamping will be in process....

First it seems that the chances are low for my approval in next couple of months now it seems Nov-June are all in same boat....


Was just thinking what you guys recommend...:confused: :confused: :confused:
