Hi all,
I am a newcomer to this forum. My wife's employer, a consulting company, filed for her I-485 in July 2002 and I have joined in that application. Both of us have applied and renewed the EAD and we are both working on EAD. My wife's project may come to an end with her present client. We would like her next project to be in the same area where we live but, if that does not happen, we are looking at options and want to understand impact of these on the I-485 application
(a) Asking my employer to process my H-1B and convert my wife's status to H4: Is this a feasible option? Does the immigration law allow H-1 B(non immigrant visa) after immigrant visa petition has been filed? Also are there H1-B visa available for this year?
(b) Going on leave on loss of pay for a period of say 6 months: My wife's employer may agree to that. Does it however have any impact on the I-485, if there is an RFE?
(c) Switching employer using the portability rule and finding local employment: What are the issues that people are facing when they try to switch employers? Our Service center is Vermont and we currently live in California.
(d) Do we have any other options of keeping the I-485 live and at the same time meeting our requirements?
Thanks for the help in advance.
