Some I-485 questions

Hello all,

As you can see I am new to this forum. I am 22 years old and actually am under my parent's case. First of all. I will admit that I do not know very much about the I-485 process but hopefully you will be able to provide me with some information. Here is what I know. Our paralegal mailed out our I-485 info in late July 2007. I have already received my worker authorization card (which makes life much easier). Now, when I check my I-485 status at the USCIS site this is what I get.

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Case received and pending.

On September 25, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our TEXAS SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.


Does this make sense? How did they receive it on the 25th of September when we sent it nearly two months before. Does it really take that long to receive?

ADDITIONALLY
: I have received my biometrics summons. I have to go this week Friday at 11:00. I figured I should work around their schedule and go when they tell me so that I can speed up the process as much as possible.

So, I guess my question is what is next? I applied for the email updates and I will update this post when I know more. Is there a long waiting time after my Biometrics are taken? I have already lost track of the years I have been waiting anyway haha (this is why the employment authorization was somewhat of a relief).
 
I apologize if I posted this in the wrong section of the forum or if the information is redundant. I am just trying to learn some more about the process around the I-485. I guess, just like everyone I would love to be able to leave the US this summer and see my country for the first time in a decade. According to some of the information posted on this website through the trackit website I noticed that most people get their approvals about 2 to 6 months after their Biometrics are done. Again, sorry for my ignorance.

GC card approval is based on many factors, such as country of origin, employment preference category, priority date (labor certification application date) and the infamous FBI namecheck.
To see the latest visa bulletin see the link below and look at the "Employment-Based Preference" section

Based on your country and employment preference category, you can find out if your priority date is within the cutoff-date. If so, then you are certainly close to the end, assuming you don't run into FBI namecheck problems.
 
Thank you so much for replying diesel. I appreciate it a lot. As I mentioned, I am just trying to learn as much as I can about this whole process. Well basically, I am Israeli (which obviously makes my country of origin Israel). I heard that people from India have a longer process. I don't know if that is true... As I mentioned I have my biometrics appointment this Friday. As far as the name check goes. I have a fairly uncommon last name and I have never committed as single crime in my life not even speeding :).

As far as the preference category I feel like we will fall under the third one. My mother is a cook (which I classify as a special skill) and my father is a home builder (which is without a doubt a skill). I was searching for the cut off dates on there but I was not able to find them. Is there a way I can make sure that I will not run into FBI problems even though my family is totally clean...?

As far as our Labor certification goes. You ready for this? BELIEVE IT OR NOT. My families I-140 has been approved since 1997! YES! I forgot the EAC number for it but I can show you guys this. Its a long story but our previous lawyer screwed us over big time. He took our money and NEVER processed our I-485. We were being lied to by him for years (we have a pending law suit against him). We thought that he put through our 485 years ago. Then we decided to go with another lawyer who didn't know what he was doing. And now 10 years after 410 approval (which is STILL valid). We put through our 485 in July. And as I said I HAVE the receipt from Immigration (It was in my first post). So, my 140 was filed in the stone age. That would be interesting if it helps us out in the end. Again, thank you so much diesel. I hope I clarified more for you...

You belong to rest of the world category. But since you got approved I-140 in 1997 your date is current. Now you have filed the I-485 and already got the work permit (EAD) the only thing to wait is for finger print. After the finger print there shouldn’t be anything at your side (assume there isn’t any RFE etc on your case). Your priority date is quite old so you should get approval earlier than others (assuming you will not stuck in FBI name check).

But there is one more thing you can do, you can file I-131 to get Advance Parole to travel outside the USA and come back without getting visa stamp on your passport.

And about 2 months, it might take 2 months to enter your data into the computer just because of July Visa Bulletin fiasco.
 
Thank you very much MA. A lot was clarified. You and Diesel have up'd my hopes a little. I had my biometrics done yesterday. Which was a very quick and easy process. They took my picture as well but I was in and out in a half hour. I will keep you guys updated over the next few months.
