My wife (primary applicant) got our EAD and AP approved 2-3 months back. We filed I-140/I-485 concurrently. She not got an RFE on I-140. No details yet, still in the mail.
We traveled to canda a month back and entered US on July 4th using our AP. So, we got a new I-94 with stamp Paroled until July 4, 2005. My wife's H-1 is expiring Aug 20th, 2004. With the RFE, we didnt want to take any risk, so we asked her employer to extend it.
My questions are:
1. Can we extend H-1 after we get a new I-94 as a parolee since we used our AP?
2. The new I-94 which we will get from the H-1 approval notice - will override parollee status?
3. I am looking for new jobs. Since I have an EAD and I am a dependent, I can join companies without having them to sponsor my visa. Because of the RFE on my wife's I-140 does it put the EAD out of status? Is it safe to switch on EAD?
