Solicitation of Prostitution Charge

Hi,
I was charged with misdemeanor for 'solicitation of prostitution' in Jul, 2004, with $300 fine & 1 year of probation and two day jail time(punishable up to six months) in California. After one year probation time, I was granted the expungement of the record and the case is clear now.

I recently got married to US citizen and visited a attorney, looking at my case and charge, he advised me that I should wait till 2014(ten year waiting period) before applying for the AOS. He mentioned that I could apply for 212(h) 1 waiver but the chances are more likely it will be denied upon AG's discretion and I could be deported easily, since I am out of status currently. He also mentioned that the only way to have 212 approved is that, my US citizen spouse needs to prove 'Extreme Hardship'.

I am unable to find the rite information regarding this issue and not sure what should be my next step?
