Social security tax

Hello,
We are going back to INDIA in January 02 due to H1 6 year limit. Does any one know if we can claim for social security taxes since we are leaving.

Please advice.
 
I dont think you can..

My understanding is that you can claim it only if you have worked atleast 40 quarters (10 years) in US.

Thanks for the reply. my husband came to US in 1991 as a student. This is his 10th year. So can we claim for taxes? We will be going back on March.

40 quarter rule

The 40 quarter rule is not for residency, but to count the time one was paying social security taxes. Unless your husband paid social security taxes while he was a student, he cannot claim the tax money. Based on my experience, students do not pay social security taxes(I did not pay any while I was a student).
