so tired with all this waiting/AP/family based 485

Hello,
My i-485, i130 and i765 were filed on Sept 2 3005. Got the work permit pretty easily. had interview and approval of 130 on Feb 22 2006 (almost 1 year ago!). Now waiting for 485 approval. I did not think it would take that long. because i am going back to Europe on Feb 22. I applied fro AP on Dec 19 2006. ABOUT THIS: Did you see that the USCIS issued a press release on October 20 telling people to apply then for AP to make sure they get before the holidays!!!1 EXCUSE ME BUT TO ME THAT MEANS about 2 month to get AP> FOr most of us, the holidays are around Dec 25th...so if they tell you to apply by the end of OCtober, that would mean less then 2 months no? I msut be too smart to think like this administration. Anyway, I am proabbly going to talk to a lawyer because my application is family-based so why is this taking so long? I wodner if I will end up leaving right before my AP is approved...which leads me to another question: how do they track all that? meaning your i-94, then see you are under a pending I-485, etc...don;t get it
Oh yes one more thing: i had a H1B valid through March 3 2007 so when i guive my i-94 when i leave on Feb 24, they will see that my i-94 expires on March 10, 2007....any chance that since I am coming back on March 11 this may help?
I am jsut so pissed to hear abuot people in the exact same situtation as me who got their 485 approval in less than 1 year!

Be happy that you are not retrogressed like a lot of employment based applicants ! (in some cases by over 5 YEARS !)

In any case, it was only your fault in assuming that the USCIS press release timing had anything to do with processing times. No where was that mentioned explicitly.
Next time, look up on the USCIS website to get the latest Processing Times

USCIS have always recommended applying for AP at least 90 days before you travel which you have done so it should come in time. It sounds like your H1 is valid on your way out but will have expired before you come back. Based on that you will need to be carrying your aproved AP at the airport in Europe before you come back. Without legal reentry paperwork you won't be able to even get on the plane.

As far as waiting a long time I know how you feel, I have about a year more wait than you so far and still no news. I also know several family based cases with 5 or 6 year waits. My only advice, keep on top of your EAD and AP renewals, the stress of forgetting and then waiting until the last moment just isn't worth it.
