i understand that if someone came illegaly and isn't in 245i, that person will have to leave the country before gettingt he visa. perhaps not even be abel to put in a petition. and if the person does leave, they may be subject tot he 3 or 10 years ban. is this true? any first-hand knowledge?

told that if a person comes legally and overstays, that person does not have to leave the country to get the visa. is this true? any first-hand knowledge?
 
IF you entered the Country Legally but simply overstayed , your Out of status will be forgiven if a USC petitions you ( I-130 and you file I-485)

IF you entered the Country Illegally without I-94/ inspection or if you can
not show legal proof of entry, it can be very hard for you to file AOS even if Married to USC and once you leave you will be banned for at least 3 years.
& rightfully should be banned for 10 years in my opinion.

and a legal resident? and i disgree with you with the bans. i think we should at least do like the old days when people needed to leave for one year or pay a fine of 1k.
 
A person who senaks into the USA with out inspection or through legal Means SHOULD NOT Be ALLOWED TO APPLY FOR AOS or receive benefits of ANY KIND, by enetering Illegally the first Act on USA soil is Federal crime and act of Defiance it should NOT be rewarded.

IF someone entered Illegally they should be Required to leave the country Wait at least 3 years before they can even apply for a visa to re-enter.


That is why those who go through the process the LEGAL way have to pay and go through such a long process because there are others who Defraud the system, steal from the USA Govt, and expect free handouts, public/ state support, and expect to be allowed to simply adjust their status or be allowed to simply pay a fine and then get treated as though they never broke a FEDERAL LAW.

I never lectured You! I was directing my reply to the PARASITE CRIMINALS who enter the country illegally and expect to gain Citizenship or any kind of priviliage when they should be sent back to their home country no questions asked!

whatever parasite, Obviously I hit a nerve with you, so you did enter illegally so therefore the only thing you deserve is to be cuffed and sent back on the next flight to whever you came from, AT your expense of course,

Not one cent should be given to those who entered the country illegally, not 1 once of leniancy should be awarded, only a boot in the arse back to where they came from, only exception is those who are political refugees and those are DOCUMENTED!

before any visa or priviliage is extended to those who enter illegally they should have to serve 4 years in the miliatry scrubbing toilets to pay back all the federal and state support they STOLE from those who deserve it by entering legally.

fine. worry about stupid slogans. you should rather focus on CIR passing and get soem relief for retro with it. like it or not, that is basically the only vehicle you have. so go aahead. keep talking if it makes you feel better and allows youto sleep at night. go ahead and feel important and intelligent. do it.

but those that really care about stopping retro and letting unsued visas go to certain people will fight. but i forget, you are the sort of person that feeling relevant and intelligent is more important than actually passing laws to bring relief.
