So close yet too far... IEAD @SFO <90 days

Hi Folks:

Went to get an IEAD at SFO in <90 days scenario. Reached at 5am. I was in at 6:45. First it was hard to get past the first guy. Fortunately I had the senator letter so he gave me token unlike probably GCVij. Got to the lady on the first counter and explained to her my case. She was very cooperative and docile. She even made a copy of certain things she needed from like copy of driver's license.

Anyway told me to sit and my name will be called. Called my name after 30 minutes and told me to go upstairs to get my IEAD as the photograph guy opens up at 8:30 am. Sort of happy but was not believing it to be too good to be true.

That is where I got jinxed. She came back upstairs called my name and said "Sir my supervisor has rejected the case as it is not more than 90 days". I pleaded with her and she said I am trying to be stubborn. She was nice again to get me back to the counter. Another woman came and I explained to her case she said you have to go by the 90 days rule but I see where you are coming from. If it was me I would have given you the card.

Anyway then came the supervisor who just was the only moron I could encounter. She was really loud not ready to listen and then told if you do not go I will put this in your record. I pleaded everything like you plead for your life (what do I tell myself at that point???) anyway she mentioned i could still work at the reciept notice as it is 90 days after which you have to show an EAD. So anyway the whatever she says I was doomed...

But one thing is for sure whatever happened may have some positive things... That's what I believe. Whether someone takes it or leaves it is purely personal.

Sorry to hear about that, I was planning to go for the IEAD at SF office next week,But now I may talk to my lawyer & ask for his suggestion.

There is no point in abusing 'coz we wanted to come to this country. They did not force us. I know people might not agree with me but inspite of us being legal, tax paying, peace loving... blah blah blah...... nothing gets to them They do not change. We just got to take at times what they say...

I believe the supervisor was anti immigrant from her comments she mentioned..... So she had every right probably... This all makes you feel no matter what you do for this country when it comes to INS you are at their mercy as if someone pleading "PLEASE DO NOT HANG ME"... Just my 2 cents:confused:
 
I also tried to get iEAD prior to 90 days but was turned back at the initial screening.

Wait till 90 days from RD and it'll be a smooth process.

btw, Is this a first time or a renewal of EAD?

Sorry to hear your experience. I am about to try the same for myself. I did not understand one thing which you mentioned -

What do you mean by this ? My EAD is expiring on 28th Feb. And my renewal application went on Jan 17th with CSC. So my 90 days wait for temp EAD end around April 17th.

Do you mean I can work for 90 days with the receipt only and not the actual EAD. Little confused here.

If this is correct I can continue with my first job which I have just got 2 months ago at the end of this month. With current scenerio if I break for 45 days at end of this month my employer will not take me back.

Please help explain me this ? I really want a way to continue working and not go out of status.

Regarding the reciept the way she interpreted it was ... that a person has 90 days to show that he has filed for the EAD renewal and after 90 days the reciept is not valid....

But you know what I do not believe her.. 'coz I checked lot of websites and there is no where written that EAD reciept is good enough to work after EAD expires.

INS is all about interpretation.. How someone interprets but it counts when you are questioned. If you can convince at that time does not matter who interprets what way/?? Please do read I245(k) law that's what she said... I just do not have a good opinion about the racist lady...

Well... I was just thinking about going to INS next Monday morning. Probably I'm just gonna hold it. I don't wanna make any trouble. INS already gave me enough. What the hell...
 
I am confused as ever!!!

I need help from you folks as I am confused as ever from my lawyer's advice as weel as the INS supervisor. It will not be till March 31 that my 90 days will done before I get an IEAD but my lawyer says that I can keep on working on the reciept for EAD that I have.

This was the same interpreation that I got from INS supervisor too. "Her words were that the lawyer and the employer can work out a compromise"....

I am lot confused. I really want to take another lawyer's advice...

Any thoughts??? Comments??? Aslo any good lawyer in SFO area that can give good advice....

Personally, I would take her advice...It's only a week so I guess it's ok. If its deemed illegal I would probably "take the week off" and "compensate for the time lost by working longer hours" after you get iEAD.
You have to read between the lines.

Actually it is not a week. My EAD is expiring on 02/26/2003. I was thinking of going of the payrool and coming back on 04/01/03 as 03/31/03 is when 90 days are done. I am on contractual basis.. So I believe I have to tell my employer. I hope he agrees. All this deep sh## 'coz of my lawyer and some on my part too that I did not apply within 90 days.

Also my RD 09/11/01 RFE 08/13/02 RFE recieved 11/20/02....

I hope I can get my 485 approved before that for WAC02-035-57***

Thanks for sharing your experience.

I think I am going to try talking to my employer too. I am contracting too but I do not know how to work this out. If my employer does not agree taking me off the payroll and work this out in some way, then probably I will take unpaid leave and might loose my current job too.

So just keeping my fingers crossed. :confused:
