I work for company A with a pending Labor certification (PD Feb 2005 RIR).
Currently I am on 7th year extension (Expires June 2007).Company A has around 25 employees.
Will there be issues like (Ability to Pay etc) during I-140 if the sponsoring company has less number of people ?
If this small company pays the Salary that has been mentioned in the Labor Certification right from the PD => Will this Prove the Ability to Pay and facilitate I-140 approval ?
Is it advisable to shift to a bigger employer at this stage and file a fresh PERM Application ?
Or should I wait till December '06 and then transfer/extend to new employer B to get H1 valid till June 2008 and file a new PERM with the new company?
Please advise me on this.
