Skilled Based PR Vs Family Sposorship

Hi,

I live in the US. I am currently on a H1b visa (1 yr remaining out of 6). My wife is a canadian citizen. She is currently living with me in US on a TN visa. She will be transfering to an F1 visa next month.

While I have applied for my green card in the US (in 2007) which may take forever to come, I was planning on applying for a candian PR.

Can you recomend what is the best way for me to go?

1. My wife sponsors me.
- Can I go this way because my wife is in the US and she won't have an income in the US(since she is going to be in school.)
- CIC told me that once the PR is approve I will have to move to Canada with my wife. (Is there no criteria that I have to spend 2 out of 5 years in canada to maintain my PR status?)(I want to move to Canada this ony if I have to.)


2. I apply as a skilled worker (My points sum up to be 88.)
- Can I do this if I Canadian Spouse?
- The reason i am thinkig about this is because here I will have the flexebility to move to Canada later as opposed to when my PR is approved.


Please let me know what are your thoughts?

-- This will be the best (and the quickest) route. Yes, what CIC has told you is correct. But the time spent outside of Canada may be counted to maintain the PR status if you are accompanying your cdn spouse.
