I work for the state and would like to know if any body had gone through the same situation or have any ideas.......

What would happen if the employer is not authorized to sign G-28 forms and file the LC application without those docs. Will DES or DOL send an RFS for that reason. I will sign the G-28 but not my employer. I really appreciate any ideas on this.
Thx.

What do you mean when you say that employer is not authorized to sign G-28? And how can you sign a G-28 for your own LC?

legal counsel

Since the G-28 form explains who the attorney is representing.....I can sign as I pay for my attorney and the attorney is representing me but not the agency as the state government agencies are represented by attorney general's office.

Any way, I talked to few people who went through the same scenario and got an answer that they haven't had any issues with it.
Still.... I would really appreciate if any body can share their opinions or experiences.
THX.

I understand your point. But I am not sure if you can still sign it yourself. You maybe right that people did not get into any issue, all that I will say is that they were lucky. Reason is that LC belongs to sponsoring company so they are going to be represented by the lawyer and not you. Perhaps no one noticed their G-28. GC is a long journey - any such thing can mess up everything at any stage! Working for state maybe helps but no I will not suggest you to do it. Try to get it done right way.

Also can you clarify why your employer is not authorized to sign it?

Two seperate G-28 forms

I really appreciate your response. I think..no, I wasn't clear enough in my previous reply. The attorney sent two copies one for my employer to sign and an other one for me to sign. When I said I can sign, I meant a G-28 form with my name on it. I did not mean I can sign for my employer.

Even the attorney said it is ok even if they don't sign but will involve a lot of work IF SOMETHING COMES UP. I think I have no other go as I have to file rihgt now inorder to be eligible for 7th year.

Regarding the employer not authrorized to sign...I think I have already mentioned that the State agencies should be represented by Attorney General's office. In case if we had to get approval...it is a whole different story.......with all IF's and But's and it would take a loooooooooong time jsut like waiting for LC approval :) So, I don't even want to wait for any more approvals.

That is OK then, if you are signing for yourself.
