Simultaneous Request for 7th year extension and for covering the outside visits

Dear ALL,

I was out of USA for 40 days total during my 6 years in two breakups. Now I know that as per H1 law, the days you remained outside USA during 6 years, can be granted for extended stay from the final day ..(In my case final date of h1 stay+ 40 days should be granted by INS if employer requests..)

Now my question is that can my employer request the same simultaneously while filing for 7th year extension and if yes then can INS validate that by granting it? I heard that shorter stay less than 180 days usually not granted by INS. Is that true?

That depend on the application your lawyer prepars. Tell clearly your lawyer to make a request for it. It is not guaranteed to get it but no harm in trying. I got 7th yr extension plus vacation stay of around 70 days. Goodluck
