Simultaneous filing for I140 and I485?

Hello,
I’m particularly interested in the timeframe that allows the spouse of a H-1B holder (which is an H-4 visa-holder) to start working after the simultaneous filing of the I140-I485 for the Green Card under the Reduction in Recruitment alternative in the Vermont office? If we assume that the I140-I485 forms are simultaneously filed in January 2003, approximately when would the spouse be allowed to work afterwards, December 2003, December 2004? Thanks in advance.

Hi, people here are deperately waiting for approvals for years-old case. I do not think people have interest in this topic. You probably should go to I140 forum.

INS has not decided how to process I140/I485 yet. They might process I140 and I485 seperately, which there is no advantage over tranditional filing. If I140/I485 cases are process as a whole, then people who filed in late time will have a long long long waiting. It is difficult to say whether it is a good thing or a bad thing for now.

However, if INS does issue AP/EAD very quickly, I bet there will be a LOT of fake or irresponsible filing. One can easily file a trival EB1, NIW case to get a quickand easy EAD/AP. Usually, one bad thing will ruin a batch of good things.

wish all concurrent filing guys good luck.
