hi,
I would like to know the importance of Divorce certificate while applying for 485. I was married in India in 1991 but seperated by 1993, also in India. But never applied for divorce since neither of us required one until 2004 when my ex-husband was getting married.
I moved to US by 2000. We finally got a formal divorce decree in India in 2004. I got remarried in 2006 to a permanent resident in the US.
I'm now going to apply for my 485, only for myself, no other dependents. I have my current marriage certificate, but I dont have my divorce decree with me now.
Could someone please tell me how it is going to impact my 485 application? Appreciate your thoughts.
Thanks, Nidhi.

If they don't ask for it, I wouldn't worry about it. If they really want to make a big deal, they may issue a Request for Evidence (RFE), at which point you can try to obtain the certificate and send it to them. But as of now, if they are not asking for evidence of prior marriage (other than just stating that you were previously married on G325a biographic information form), don't worry about it!!

Thanks jk0274 for your response. thats so much a relief, for now at least. But, I just noticed that I-140 has been retrogressed, for EB2 skilled prof, it moved from Sept 25 '06 to Jan 01 '06..and mine is Dec 5th '06..i'm not sure now how thats going to impact my I-485 appln. I just fedexed the documents to convert my I140 to premium to my attorney y'day, I guess a bit late. I also got my documents ready for 485 appln..had the medical done too..dont really know what my options are now.
Thanks, Nidhi.

you are doing right things i.e. converting 140 into PP. You should have it approved in 2 weeks unless there is an RFE. Regardless of 140 decision, you can still go ahead and apply for 485. Do not worry about your divorce decree. You do not need it. You should be fine. Good luck...
