sibling on AOS, applying for F1

hi!,

My brother is applying for F1, should he mention about my self in DS forms, I am on AOS

My H1 is cancelled, I am working on EAD

It pays to be truthful.
If the form requires applicants to mention relatives in US, he should mention your status. Otherwise he will be lying under penalty of perjury. If he is later caught he will be banned for life from entering US.

I am on AC21, my company "A" got bankrupt long back before approval on 140, i applied for 485 myself, worked on H1 for company "B" for 1 year, got terminated after client project expiration, and now I have joined another company "C" as permanent employee...

I dont know what should he tell visa officer...I just dont want to confuse with so many detail..incase i just dont want they should start some sort of investigation on me

how much info they can trace from my details, I dont know in how many doc. i have mentioned my parents name, i dont know if they do recurrsive search based on names of siblings, parents in the visa application for F1

Pl. help its kind of urgent, his visa interview is on 1 aug

Your current immigration situation should not bother the consular officer who will review your brother's application.

As for your brother, if he actually states in his application something false, the consequences of that will be not very pleasant. He won't be able to come to US legally anymore.

It is true, though, that your brother's application can be turned down due to the fact that he has relatives in the States. But this is the risk he should be willing to take. In doubt, consult with your lawyer and see if you can work out a particular strategy.
 
Two kids I know, whose parents are already permanent residents have arrived in the US and are studying here for the past 2 years. They have not informed INS about their parents being here. All is fine with their lives so go figure. Seedhi ungali se ghee kabh nikli hain?

I buy what bitterman is saying. Its better for your brother to mention the truth and that you are in AOS. That shouldn't matter for his F1, mostly. That is a risk he has to take.

It was hindi and it was meant for Ramavtaar, who just happens to be an expat from the same country I'm from, and Hindi is Indias national language and I will uphold my right to use it. Especially in a forum where obscenity/vulgarity runs wild, to tie the hands of a person wishing to convey a qoatation/saying in a native language(read any language other than English) is somewhat of an irony.
In english, it means, ghee(english translation not known to me) was never extracted from a straight finger,

Anyway, how could they get in trouble for not informing about their parents? When? It was done after taking legal opinion, which should amount to something.

Its getting little bit complex on F1, BTW how much information they have on siblings or parents?

Did any of you see any case with no getting thru mentioning siblings name and it popping up on visa officer P/C or database?

Uh-oh, a lawyer actually advised to lie in a visa application?

Well, it is not something new, I suppose. Such lawyers should be disbarred.

As for "when" it could get them in trouble, well... once lied, they will be forced to cover up their lies forever. It means that each subsequent petition or application with DOS or INS will have to be consistent with the original lie, otherwise a simple cross-reference check will reveal it. Could they never be caught in their lies? Possibly. But there is too much at stake to rely on a simple possibility. Younger people tend to underestimate risks, though...

On the other hand, some people choose to overstay their visas or come to this country illegally. So it is just a matter of principle to comply with the laws, I guess.
