Hello:
There is a consulate name on my i140 application.
This was done by my lawyer so that I can decide
AOS vs CP after 140 is approved and PD is current.

After my 140 was approved and my PD became current I filed
for 485 last week. Do I need to inform NVC that I am
not going to CP? Or is it done automatically? I believe
NVC sent a packet3 for me to my lawyer\'s address.
please advice,

I think you should! My lawyer didn\'t do so therefore my I-140 was forwarded to my home country and it took about 2 MONTHS for CSC to get it back!!

Can u please elaborate on your case ,

Even though when we haven’t requested for CP , I-140 approved for CP. But my lawyer just wrote a letter to NVC , not to abroad consulate is it much to do that.

How did u know that your case was delayed for 2 months cause your I-140 was transferred to consulate and to get that it took 2 months.

Can u please post some on this . Each lawyer is doing some thing different no one knows what to do exactly.

IF YOU FILLING THE PACKS FROM NVC THEN YOU ARE GOING FOR CONSULATE PROCESS IF NOT AOS. NO NEED TO INFORM NVC BECAUSE YOUR 485 OR AOS.

kanti, if your lawyer has written a letter to inform NVC that you\'re not going for CP then you should be fine.

In my case, when my lawyer received PK III from NVC in Feb., it said that my I140 has been forwarded to consulate in the cover letter. (We didn\'t ask for CP on form I140!) Then I called the consulate in March they said they haven\'t received request from CSC yet. I called again in April and found out my file has been transferred back to CSC in mid April.

I had been in the same situation. I had also received my packet III when my I 140 was approved. I almost filed them and sent it to chennai, but I changed my mind the last minute and filed I 485. I did not inform anybody.. And I got my I 485 approval last week without any problems. In fact my ND 02/09/01 and approval date was 06/08/01. This was my. In anycase I think you lawyer would be the person to judge your case.

my lawyer said
"No need to notify the NVC that you have filed for AOS"

those were his exact words...

technically you don\'t need to. but, its always better to do it to avoid any possible delay. this is what happens when you file for 485.
ins won\'t have your case(because they would\'ve already sent it to nvc upon 140 approval) and so requests nvc to send the case back. by that time, if nvc already sent it to the consulate abroad(which happens about 2 weeks after they send packet3 to your lawyer), then ins will contact the overseas consulate to get the case back which will cause unwanted delay.

looking at current ins processing times, its very likely that nvc would send your case to overseas consulate before ins even opens your 485 petition.
