Hello, there,

My EB1a was approved months ago. Now I just received an e-mail about my EB2 NIW from USCIS, said addditional evidence requested. Should I reply that RFE or just withdraw my EB2 NIW petition? I'm kind of tired of this boring things and don't want to waste more time on it since I already have an approved EB1a anyway.

If withdraw it, how to do it? write a letter together with the RFE letter copy?
If I don't withdraw, Will it make any negative effect on my approved I-140 and pending I-485?

Anyone has more experience to share?
Thanks.

You can withdraw by writing a letter and giving them the photocopies of your RFE, receipt notice etc for proof. Congrats on your approval

pswami,

Do you think I need to tell them that the reason I want to withdraw this EB2 NIW petition is because that I have an approved EB1a petition and my I-485 will go with the later?

ANyone has similar situation?

Thanks pswamy, hopefully the withdrawal will not make any negative impact on my GC application.

I just feel not right that they didn't approve my NIW directly, as I believe I'm quite qualified for that.

credentials?

wlj,

congrats on ur EB1-EA approval. could you brief your credentials - i wanna see why EB1 was approved and not nIW.

I think I posted my credentials months before. Briefly, 7 first-author English papers (and of course, some papers in forgein language) in biological/biomedical field during Phd and postdoc, 70 citations, several international/national travel award, several graduate scholarship, 1 patent, 2 book chapters, some internet media citation/report, etc.

My NIW and EB1a were DIYed, so, maybe my cover letter for NIW was not well-written.

want to receive a copy

can I received a copy of the documents you sent? thank you. I am also applying for EB2-NIW.

I just received the RFE letter about my NIW petition. Nothing specific mentioned in it. Nothing about any details on my materials. I deeply beliiiiiiiiiiiiiiiieve that those immigration office idoits lost all my materials again, just as what happened to my EB1 petition. that time, I got a RFE too, but they somehow found my file from a dusty corner before I got a chance to answer the RFE.
I just don't know whether they can find my file this time...
