Should i stay or should i go?

After posting a bit on this forum. I am thinking it might be wise to return home and resume employment back in canada and file from there so i can be working while i wait. Will this affect the way my application is processed? I mean my wife will be staying here in our home back in the USA. Will she have to travel to canada for my interview and bring our son?

It just seems that three months more without me working would drive me nuts. Would i be best off filing from my home in Canada. Or is me returning back to Canada to do that a bad idea?

I mean we have a home and bank accounts together and also a child. Im hoping this wont be a huge problem? I have never overstayed or been out of status. I was married in the US. I just dont want to risk being banned or something odd.

If your here you might as well stay. Im in a similar boat in that I cant stand not working. Some nights I cant sleep because of it. Its killing me, but its a sacrifice I gotta make. If your here and you have filed your change of status you can legally stay until you get approved or denied. Also if you have never overstayed, you should be able to go back to Canada without a penalty, something I cant do.I would just hurry up and file everything and just wait here in your case. Sometimes work permit can come in as little as 1 month 1/2, you might get lucky.
 
i think what im asking is if i file in Canada am i banned from visiting my wife? I saved up $28,000 us and ive purchased our home and car but not working is causing a serious drain on our finances.

If im working in Canada i can at least support us properly during my wait. I spend many a night awake because i feel inadequate in the way of financial support it almost drives me nutty.

At the current time i can freely travel between Canada and the U.S im given no trouble at the border. I have no criminal record or bad history. But if i file in Canada im worried about being banned until i get permission to return.

We could use the extra $15,000 i would make working for 90 days to renovate our new home. But i mean if i get banned for 3 months that blows plus ive heard they can take longer to process cross border paperwork.

If i file in the US how long until i could travel to canada while waitign for my work permit?

I could just suck it up and ride it out. But 90 days could deplete our finances at this point. My wife just doesnt make enough. Plus if i go back to working at my old company i can transfer to the us with them. I think that might help with the affidavit of support? Sorry for all the questions but we got married so we wouldnt be apart but i feel i need to work soon.

You can definitely face problems re-entering from Canada if you leave after applying for AOS and without AP in the US. And you probably won't be allowed in the US with CP pending without some drama... I filed in the US, I got my AP (permission to travel) only a few weeks before I got my EAD, that seems to be pretty normal, it's probably not worth going to Canada to work on AP when the EAD should not be far behind.

I think ultimately what you do is a personal decision... In my case, although I missed not working while waiting for the EAD, I knew it would feel worse for my husband and I to be apart. But then we could afford to live on his income, and I also have a private income so I still felt like I was contributing. I know it makes a difference.

We can offer our opinions, but only you know which is most important right now... being together or making an income and feeling like you're contributing through work. Hopefully, in a few months you can do both... whatever you choose it will go quickly, I promise! It seemed so daunting when I applied for AOS... but it moves along faster than you think, especially when you've stayed legal and there aren't those issues (touch wood.)
