Hi Guys,

I am in bit of confusion.I have an H1 extention approved but unstamped and approved AP.

Should i stamp my H1 this time i am going to india or i use my AP to reenter. If i use my AP i have to start working on EAD.

Is there any chance my H1 stamping getting rejected because in application DS-156 ther is a question asking have u filed immigrant visa.If I say yes can they reject stamping and put rejected stamp on my passport which is bad.

stamping h1 makes life easy for travel/work

Any suggestion?

thanks

Re: Narmis

Then answer to your below question is YES you can get it stamped as an H1B Visa is issued with dual intent, that is it can be used for applying immigration too... I also just recently got my passport revalidated and have my applications pending at VSC for I140/I485.. it sure does make life easier with stamping.... Do discuss with an attorney too... these are my views..

Thanks

I was in a similar situation like you 2 months ago.

I went to India and applied for H1 stamping at Chennai consulate through the TTS drop box facility and got my visa and passport in 3 days.

Also in form DS156 I answered YES to the question asking me If I had applied Immigration visa and by who.

Dont get worked up !!! Relax and get your passport stamped.

Good Luck !!!!!!!!!

tamilpayyan,

Was H1 extension below 6 years of stay or more then 6 years?

Wondering will there be any problem to get stamping in India for 7th year extension?

Thanks.

Mine was below 6 six years.

I dont think there should be any concerns for getting 7th year extension visa stamped.

Good luck.
