Should I resend I-130 evidence with I-485 AOS if it was filed 3 years ago and approved 6 month ago?

Hi,

Here is my story.
  • In 2006 my LPR wife filed I-130 for me.
  • It was approved 6 month ago.
  • In 2 weeks I’d be able to submit AOS applications because on 01/19/2010 my wife has Oath Ceremony.
Now. Should I resend I-130 supporting document and evidence such as: family photos, marriage certificates, our kids birth certificates, 325As etc. or a copy of I-130 approval is sufficient?

Since 2006, the time when I-130 was filed, there were no major changes except for a birth of our second son.

Once your wife gets her Citizenship. To upgrade I-130, you will just need to send a cover letter (noting the status change of petitioner), a copy of her Naturalization Certificate and a copy of the I-130 receipt notice. Have sent the same in for my spouse.

Can you please let me know the procedure for upgrading the I-130 that is not approved?

Can i still apply for EAD along with the 485? How long does it take to recieve the EAD?

All you need to for AOS is file I-485 with the usual associated documents (marriage certificate, birth certificate, medical, etc.), and include a copy of the I-130 approval and her naturalization certificate, and they will figure it out. You don't need to submit a separate upgrade request. And don't send family photos. Bring that to the interview.

No special upgrade procedure required if you are filing for AOS. Just include a copy of the I-130 receipt with the I-485. And see my previous post.

Thank you all for your responses. One more thing is bothering me. Do I need to attached my wife's G-325A to I-485, or only mine is required. And also how many copies, 4?

Should I update approved I-130 and G325A if my wife (petitioner) changed her last name by by virtue of naturalization?

If a G325A was already submitted, send another one with the I-485. If her name change is other than taking your last name, submit the name change order with the I-485 (otherwise, if the name change is just to take your last name, sending a copy the marriage certificate [which you would be doing anyway] should be sufficient). And point out the name change at the interview.
