Should I renew my EAD or wait?

Hi,

I responded to a Medical RFE on 08/02. My current EAD expires on 11/09/04. I saw others getting approval in 10 days after respoding an rfe. But it's about the time for me to renew my ead. What's going to happen to ead renewal petition if your 485 is approved in the mean time? Or should I take a chance and wait for the 485 approval?

Please let me know your opinion.

thanks.

It does no harm to file for renewal except for the money you pay for EAD renewal. You would be better safe than sorry and hurry around at the last minute.

If the approval comes well and good, all you might have lost is the money paid for renewal, but if not, you might end up worrying and hurrying and being tensed etc.

You have a choice to make, It is up to you.

Considering the slow pace of USCIS it is better to file for EAD renewal.

It all depends on your situation. From your post its not very clear if you are currently working pursuant to that EAD.
Assuming that you are not, then you don't have to - just continue to work in H/L status and if your 485 is not approved in about 30-45 days, then you can revisit this issue.

If you are working on your EAD now, you risk losing your job when the current EAD expires .... Personally, I would not take that kind of a risk.
I'll apply for EAD renewal ASAP and hope for my 485 to get approved.

thank for your resposes,
I am currently working on my EAD. I have 96 days starting today till the expiration date. I will renew it right away.

Someone told me that if you apply for EAD, CIS will delay the 485 approval until the EAD is approved. Actually that was my concern. What's your opinion on the above statement?

That does not make sense, it might have been a coincedence in your someone's case.

But if you case is clear things should fall in place and you should get approved soon.

Hence file for EAD to be on the safe side, I did that and got my EAD and in 2 months our (my wife's and mine) case were approved.

Good Luck

Your EAD expiry date is 11/9. Therefore you should file for renewal before 8/9 with some safety time to go (which means now). EADs are getting approved in a month but you never know and should not risk your future on USCIS processing times of all the things. 8/9 is the date 3 months prior to the expiry date so even if the USCIS approval is stuck, you can still go and get iEAD.

(Quotes mine, it just looks good when enclosed in quotes :))

Would not hesitate for a second. I would apply right away.

Me an you will have waited for three years soon. Looking at one year old cases getting approved tells me we are out of favor with whatever system is being used. Would not bet a penny on their speed or fairness...
