Should I reapply for my EAD?

I received a letter from the USCIS stating that my 3rd EAD has been rejected because my I-485 has been approved. But, on further scrutiny I found that the alien number in my I-765 (EAD) is incorrect. I have called, mailed, faxed n number of times…but don’t know what is happening on it. Anyways, I got an RFE for my I-485 and my lawyer may respond to it today. I am currently working on my H1B and don’t really need my EAD. Should I wait till I get an answer to my RFE or should I reapply? If I have to reapply how long can I wait…my current EAD expires on Jan 22nd 2005?

It would be better to reapply now because you will need an EAD if you get laid off or terminated or switch to another job using AC-21 method or your H1 expires. This is best advantage. You don't know how long it will take to be approved after responding to your RFE for your 485. There is no timeframe to get an approval after responding to a RFE (it is up to adjuicators to make a decision to approve or not).

So it is up to you to reapply for EAD or not.
 
Would there be a problem in getting my 3rd EAD (I don't care if it takes 2 to 3 months) if i apply about 15 days ahead of current one expiring, as i am on H1B (expires June 2005).
 
If you haven't received your 3rd EAD yet and your h1 expires in Jan, you should stop working until you get your approved 3rd EAD (Note: you are still in pending 485 status). If you haven't received your 3rd EAD for 90 days, you should go to the local office to obtain an interim EAD.

Talk to your lawyer.. maybe there is option of taking a vacation leave or unpaid leave etc. but first talk to your lawyer.

My H1B expires in June 2005 and not Jan 2005...so i guess i have time... correct? My EAD expires in Jan 2005
