Should I mentioned 1447(b) during Infopass?

I scheduled an Infopass appointment on Thursday. I'm sure all I hear will be "Your FBI name check is still pending, sorry, that's all we can do". Should I go ahead and leave them some info on 1447(b) for their education purposes? I know that it's just a local USCIS office, but maybe that will make them thinking...

For the third time I went to the INS and I had the same answer: " Name check pending sorry you have to wait it can take up to three years!!!!

Yeah, I love that - they make you go to the office so that they can tell you "We can't help you, sorry" Why can't they tell me that over the phone?

My friend try and keep it "Real" and if you serious about it *file the lawsuit*
Whoever you'll be talking during your INFOPASS could care less about reminding them about the law and whatnot, to them is just a simple job .
My guess is the only person that cares about 1447(b) is the person in charge with your local INS and few other people inside there

p.s. i didnt mean to come to harsh on ya but its the truth and sometimes it hurts

I didn't mention 1447 specifically during my INFOPASS appoinment in September 2005 but I did mention that the 120 days will be up in a month. The information officer didn't seem to have a clue as to what I was talking about.
I don't think they care until after the case is filed in court. I sent several letters stating my intentions....no response. I sent them a draft copy of the petition and gave them 4 weeks....no response. I called the District Director a few days before the end of my deadline and all she told me was that my case was stuck because of my namecheck and that there wasn't anything more she could tell me.
Being a bureaucracy, they won't do submit an expedite request because a case may be pending. They wait until the case is pending.
My advice to you is don't mention anything about 1447b. If you're going to file file the day after the 120-period has ended. Don't waste your time writing letters as its not required under 1447b and it doesn't do anything.
 
Dont waste your time mentioning stature or the law. Most CIS officers are incompetent and will have no idea what 1447 is . Might sound like an extension or Zipcode to them. If you want to sue, just go for it

You rather live the info with the janitor...it's a better chance he will be more interested about it than the guys you're about to see at your infopass appointment :D

It depends first whether you did file the suit or not. I think what you can do is; if you are going to file the suit under 1447 b, and you're planning to hire a lawyer, it'd be helpful to let the lawyer contact them just before filing the suit. This will seem to them much serious than you just telling them about the 120-day rule and your plan to file a suit. It's all speculations my friend. We are all in same boat, and just sharing ideas.
