Depends on what USCIS asked you to do in the RFE

thanks,
they asked about permanent position, I got some letters from bosses but I think h1b approval should help too.
I filed under eb1b (OR)

Is it Eb1OR category!
If yes, I am not sure how this will help.
There are several threads by NSceb1, Krendel, Pamit which details about requirements of this kind of RFE.
I will advise you to read AAO decisions ...to track in any case H1B document had any negative impact on decisions.

I don't reallt see how the H1B papers will help you here. In my opinion it might even weaken your case since one might argue that H1B is only valid for 6 years. I think you should try to prove the point by ohter evidences then H1B papers.

NSC, i sent everything in December, 2004, got RFE in July. Sorry, Don't understand what is nd?

You can not argue that your position is permanent on the basis of H1-B. USCIS will toss it out..

If you are in University get a letter from Higher up in University Dean, HRD etc. other than your supervisor. Also include your intial appointment letter which should describe your position and state that your position is for unlimited duration that is does not have any end date. If in company get a letter fron HRD Manager etc. I hope you have not put in the magic word "post-doc" in your current title.

VVP,
It will help us if you could give us little detail about yourself and clearly about you RFE. The RFE for permanent position is written in different way.

1. Are you post doc or Research Associate. Although both 80% times both means the same for universities but Immigration people well differentiate between them. If you are RA or anyother position other than Post doc then its going to be easy RFE for you.

2. As suggested earlier by many ....get letters from 1. Boss 2. Dean 3. Business office 4. Human resources which says that you are permanent. They also look for an offer letter which says you are permanent.

3. Defination of permanent varies with university.Sometimes u need to be tenure track or nontenure track for being permanent. Sometimes if you work more than one year its permanent.
