should I file ammended I-140 as no RFE issued for name change or merger

Greetings,

My company merged several month ago with another and initially had not changed its tax id (not sure now though)

EB2 ND 2/00 Other

I have been asked for 2000 taxes, 3 pay stubs and 200-0 W-2

Talked to my lawyer if I should file ammended I-140 .. he said no need as INS has not asked for one ...

Can I get rejected for this or will it be overlooked ..

can you give your exact RD/ND ? date of RFE ?
your 140 and 485 have same employer name I assume.
I think when the INS receives your tax info with a different
employer name, they will not ask for a new 140, they
will probably wait until new guidelines, then approve.
That\'s just my opinon.

My
RD is 2/7/2000
ND is 2/14/2000
RFE is 3/26/2001 (I think could be 3/14/2001 forgot)

Yes 140 and 485 have the same name ...

So do I run risk of outright rejection (if so how much)

I\'m going to sumbit the info by the end of this week .. how far do you think I am from the finsih line .. thanks,

I don\'t think there is a risk of rejection at all. Once you submit
the RFE response, they will find out that your employer name
has changed, and they will wait for the new guidelines and
then approve you.
As far as a timeline, it all depends on when this 180 change
of job rule guideline show up, people say it should be in
by the end of this month.

My lawyer\'s advice was to not file an amended I-140 for the following reasons:

- by default it has no correlation to your 485 application
  and will take months to approve; even after gets approved,
  it does nothing to speed up processing of your 485 nor
  does it stop VSC from issuing an RFE anyway

- if you get a RFE/I-140 redo request and respond to that, it
  will take days to approve instead and at that point you are
  pretty much done with the process

Based on this, I myself decided against doing a proactive I-140.
