Should I apply for GC ???

Hi,

I did my MS in CS in Dec 2005 but took early OPT and started working from Sept 2005. I am in California and working for very reputable company in IT field. My Salary is 75K + bonuses. My company applied for my H1 in 1st week of Jan and it got approved and it would be starting from July.

Two days ago HR send me email that I am eligible for GC processing and if I am interested then they could process my GC application.

Is it save now to go GC or should I wait for a year or two for that.

I have around 18 months expereince from my native country in IT field beteeen my BS and MS.

Would I qualify for EB2 ? If not then should I wait for it or should I start with EB3 ??? Is my salary range okay. I see my salary around 85K in 2 years period.

Please advice me what to do ???

You are ok

Make sure you have good exp letters that match your skills. Get a good lawyer maybe Rajiv Khanna and go for EB-2. I think you can qualify for Eb-2

In other thread I read that you should have MS degree in hand when you start job to be qualified for EB2. I started 3 months earlier :-( on early OPT before I could officially get my MS degree.

Should I get experience letter from my native company. I guess the company has gone out of buisness so what I should do though it was a good company but owner sold it to other company.

Where could I find Rajiv Khanna ??

With EB2, how long does it take generally for Labor. I am from "Other countries"

Like I said in other thread. EB2 is doable but big risk since your degree received after joining the company. Since it is US degree, it is much harder to prove that you complete degree requirement before joining to the company (International degree usually requires more credits to complete, so it could easy to prove). I have seen this case. One possible way for you is to try get a letter from your ADVISOR or DEPARTMENT head that you have been completed all degree requirement before Sep 2005 and just wait to get degree only. It is still a big risk. You need a good lawyer to help.

For big company, they have their own lawyer and they are free, so it is funny if you have to pay any money out of your pocket for those immigration stuffs.

Yeah my all requirements regarding courses were fullfileld except my MS project submission.

Yah I would not have to pay any thing from my pocket as my company would bear all expenses but I was wondering that if I could get free advice from Rajiv Khanna as most of them give free advice initially.

I could try to get letter from my department saying that my all requirements were completed by the time I joined company but offcially graduated in Dec 2005. Would they buy this ???

Wats timing duration between EB2 and EB3 ??

They might buy that but hard to do (RFE might be issued). If they question about Master requirement, you will be in trouble. Master requirement is course work PLUS PROJECT (EVERYONE KNOW THAT) or completes 30 credit hours ( You will not get the grade (alphabet or Pass) for the project until you submitted that right ? So the number of credits are not enough)
Some people pay words with USCIS by getting the letter "complete all requirement course works" but they usually have more than the required course works beside the project. I would wish your luck, not me since I don't want to wait for 1 or more years later to find out that the I140 denied and the LC is taken over :)

Duration ? Just check the visa bulletin.

I am from other countries and EB2 and EB3 would make a lot of difference for me.

I joined my company 2 months earlier before my MS degree , is there any way that I could qualify fro Eb2. Like job description change after MS or position change, I am in QA and show that I moved to dev position. Even my company rasied my salary by 4K after my MS degree.

Is there any way that I could qualify for EB2 ???

I checked my MS transcript, I took project credit hours in Spring 2005 and got satisfactory on that then zero hours in summer 2005 and then registered again zero hours for MS project and again got satisfactory. So basically I could graduate in spring 2005 but I did not . I could even try to get a letter from my department that my all requirements were fulfilled before the time I joined this company.

I am desperate to apply for EB2.

Please help me with your advices.

If you could get the letter, you may have a chance at I140. However, you need to find an education evaluation company to qualify that you meet US MS requirement by the time joining the company.

That is what I see the lawyer of my previous company did for my co-worker. Just keep in mind you will get RFE for that, you need to have a good immigration lawyer to help.
